These terms apply to wedding cake orders placed with The Incredible Cake Company.
They are intended to make clear what you can expect from us and what we need from you to make sure your cake is created and delivered as planned.
1. Booking your wedding cake:
Your wedding cake booking is confirmed once we have received the required deposit and agreed the booking details with you.
A deposit of £100 or 25% of the total cake price, whichever is greater, is required to secure your booking and reserve your wedding date.
By paying your deposit, you confirm that you have read and accepted these Wedding Cake Terms & Conditions.
Your booking is for the cake, design and details agreed with us at the time of booking. Any subsequent changes are subject to the terms below.
2. Payment:
The remaining balance is payable by the date shown on your Wedding Cake Details form, normally no later than one calendar month before your wedding date.
Your cake will not be prepared or delivered until payment has been received in full.
If payment has not been received by the agreed date, we will contact you to arrange payment. If the balance remains unpaid and we are unable to contact you, we reserve the right to treat the order as cancelled by the customer, subject to the cancellation terms below.
We will provide you with a Wedding Cake Details form confirming the agreed cake design, flavours, portions, delivery or collection arrangements, payments received and balance outstanding.
3. Cake design and changes:
Wedding cakes are bespoke and are made to order based on the design discussed and agreed with you.
We will make every reasonable effort to reproduce the agreed design accurately. As cakes are handmade, however, minor variations in colour, texture, decoration and finish should be expected and are not considered faults.
Where a design incorporates hand-made sugar flowers, models, figures, painted decoration or other individually crafted elements, these may vary slightly from photographs or sketches.
Any significant changes to the design requested after booking must be agreed with us and may result in an additional charge.
Changes requested close to the wedding date may not be possible, depending on the stage your cake has reached and the availability of materials, ingredients and our production time.
Changes which reduce the size, number of tiers or overall price of the cake may not result in a corresponding refund where work has already been carried out or costs have already been incurred.
Changes which increase the size, complexity or cost of the cake will be quoted separately and must be agreed before the additional work is undertaken.
4. Final details:
We will ask you to confirm your final cake details, including design, flavours, portions and any other relevant requirements.
Once these details have been confirmed, changes may be subject to additional charges or may not be possible, particularly close to the wedding date.
It is your responsibility to check the Wedding Cake Details form and let us know promptly if anything is incorrect.
5. Flavours and dietary requirements:
Our cakes are made using a range of ingredients and our kitchen handles allergens including gluten, milk, eggs, soya, nuts and peanuts, among others.
Please tell us about any allergies, intolerances or dietary requirements when booking and again when confirming your final cake details.
While we will take reasonable care when preparing cakes to meet agreed dietary requirements, our kitchen is not an allergen-free environment and we cannot guarantee that any cake is completely free from traces of allergens.
We will provide allergen information for your cake on request. Please do not rely on assumptions about ingredients or previous orders; always ask us if you have an allergy or intolerance.
6. Flowers:
Where fresh flowers are to be used on your wedding cake, these should normally be supplied by your florist.
We will discuss the arrangements for receiving the flowers with you or your florist before the wedding.
We will take reasonable care when placing flowers on the cake, but we cannot be responsible for damage, wilting, contamination or other problems caused by flowers supplied by a third party.
Please ensure that your florist is aware that flowers are being used on a food product and that they are suitable for this purpose.
We reserve the right to decline to use flowers that we consider unsuitable or unsafe for use on a cake.
7. Delivery and setup:
Where delivery and setup have been agreed, the delivery charge will be confirmed as part of your booking.
We will agree a delivery time or delivery window with you in advance.
Please ensure that there is suitable access to the delivery address and that the cake table or display area is ready before we arrive.
We cannot be responsible for delays caused by circumstances outside our reasonable control, including traffic, road closures, accidents or severe weather, although we will always make reasonable efforts to keep you informed.
Once the cake has been safely delivered and set up, responsibility for the cake passes to the customer or the person responsible for the wedding/event.
8. Cake collection:
If you have chosen to collect your cake, we will provide reasonable instructions for transporting and storing it safely.
Once the cake has been collected and has left our premises, responsibility for its safe transportation, storage and handling passes to the customer.
We cannot accept responsibility for damage caused after collection, including damage caused by unsuitable vehicles, movement during transportation, incorrect storage, heat or other environmental conditions.
We strongly recommend that wedding cakes are collected by someone who is able to transport them safely and who understands that they need to be handled with care.
9. Cake table and venue arrangements:
Unless specifically agreed with us, setting up the cake table, decorations, flowers, stands, cake toppers and other items not supplied by us is the responsibility of the customer or venue.
If we are delivering and setting up your cake, we will only be responsible for the elements that we have agreed to provide.
Any cake stands, boards, separators or other equipment belonging to The Incredible Cake Company must be returned in the condition in which they were supplied. Any loss or damage may result in a reasonable replacement or repair charge.
10. Cancellation by the customer:
You may cancel your wedding cake booking at any time.
If you cancel, we will calculate any refund due based on the work already carried out, costs already incurred and any loss we reasonably incur as a direct result of the cancellation.
We will take reasonable steps to minimise any loss, including offering the original date to other customers where this is reasonably possible.
The deposit is intended to cover work and costs associated with securing and preparing your booking and may be retained where this reflects our genuine loss. Any refund will take into account the circumstances of the cancellation and any costs or losses that we have been able to avoid.
Where the cancellation takes place sufficiently far in advance for us to re-book the date, the amount retained may be substantially less than if the cancellation takes place close to the wedding date.
We will not retain or charge more than is reasonably necessary to cover the loss we have actually incurred.
11. Postponement or change of wedding date:
We completely understand that wedding dates sometimes have to change for reasons outside a couple's control, and we will always do our best to help.
Please let us know as soon as possible if you need to postpone your wedding.
Where the new date is available, we will transfer your booking and any payments already made to the new date.
If the date is changed more than one calendar month before the original wedding date, there will normally be no additional charge.
If a wedding is postponed within one calendar month of the original date, we may already have carried out work, purchased ingredients or materials and, because the date has been reserved exclusively for your wedding, may have turned away other enquiries.
In these circumstances, we may retain an amount from the payments already made to cover the loss we reasonably incur as a result of the late postponement.
We will take into account any work or bookings we are able to undertake for the original date, as well as costs already incurred specifically for your cake. We will take reasonable steps to minimise any loss, but a late postponement may mean that we are only able to replace part of the original booking.
Any amount retained will be proportionate to the loss reasonably incurred and will not exceed 30% of the original cake price.
Any remaining payments will be transferred to the new date.
We appreciate that postponements are rarely something couples choose to do, and we will always take the circumstances into account and aim to deal with each situation fairly and sympathetically.
If the new date is not available to us, the postponement will be treated as a cancellation and the cancellation terms above will apply.
12. Cancellation or non-performance by us:
We will make every reasonable effort to fulfil your order as agreed.
In the unlikely event that we have to cancel your order and are unable to provide the cake, you will receive a full refund of payments made to us for the cake.
If an alternative arrangement is possible and appropriate, we will discuss this with you first.
Nothing in these terms limits or excludes your statutory rights.
13. Circumstances outside our reasonable control:
We will not be responsible for failure or delay caused by circumstances outside our reasonable control, such as severe weather, serious illness, accidents, fire, flooding, major power failure, transport disruption or other events which could not reasonably have been anticipated or prevented.
If such circumstances affect our ability to provide your cake, we will contact you as soon as reasonably possible and work with you to find a suitable solution.
Where we are unable to fulfil the order, your statutory rights will not be affected.
14. Photographs and social media:
We may photograph cakes we have made for our portfolio, website and social media.
We will not use photographs in a way that identifies you personally without your permission.
If you would prefer us not to use photographs of your cake for promotional purposes, please let us know.
15. Complaints and problems with your cake:
We take great care to produce cakes to the agreed specification and to a high standard.
If there is a problem with your cake, please contact us as soon as possible so that we have an opportunity to understand the issue and, where appropriate, put it right.
If there is an issue with a cake after delivery or collection, please provide photographs where possible and let us know promptly.
Nothing in these terms affects your statutory rights.
16. Our commitment to you:
We will carry out our work with reasonable care and skill and will make your cake in accordance with the agreed order.
Because our cakes are handmade, small variations from photographs, sketches or previous examples are to be expected. These variations form part of the handmade nature of our cakes and do not normally constitute a failure to provide the agreed cake.
Where a particular colour, flower, topper, ingredient or other element is essential to the design, we will discuss this with you in advance.
17. Changes to these terms
These terms apply to the booking as agreed with you.
If we update our terms in the future, the new version will apply to new bookings and will not retrospectively change the terms of an existing booking unless this is agreed with you.
18. Your statutory rights
Nothing in these terms affects your legal rights as a consumer.
Where there is any conflict between these terms and your statutory rights, your statutory rights will prevail.
